Trap in Section 82 CrPC - Don't Fall for this Common Error!

crpc_bnss du_llb beginner trick_question

Okay, so here's a question that might look simple at first, but trust me, it's a trap. In the DU LLB Entrance, they asked: "Section 82 CrPC is applicable when - (a) the accused is found insane (b) the accused is found unsound (c) both (a) and (b) (d) none of the above." Most people will mark either (a) or (b) because they think these are the same thing, but NO, they're not. Section 82 talks about the accused being deemed to be of unsound mind, but the key here is that it's a legal presumption, not a medical diagnosis. The twist is that the prosecution doesn't have to prove the accused is insane, just that they're acting strangely, which could be due to various reasons, not just insanity.
