Torts Law is too Eurocentric, time to Indianise it!
torts ts_lawcet advanced hot_takeI think our torts law syllabus in TS LAWCET should focus more on real-life cases from India, rather than just relying on English cases. I mean, why use Rylands v Fletcher when we have a plethora of case laws from our own country that deal with identical issues? It's like studying cricket by only looking at international matches, without watching IPL highlights. Where's the connection to our reality?
Take the landmark case of M.C. Mehta v Union of India (1986) for example. It deals with public nuisance and environmental pollution, which are super relevant to Indian realities. We should be teaching these cases instead of wasting time on Victorian-era English cases that are a century old. It's time to Indianise our torts law syllabus and make it more relatable to our own experiences and challenges.
Bhai, yeh baat toh sach hai ki Torts Law mein Eurocentric approach hai, lekin Indianising hi nahin hoga. Hamara aim should be karna ki hamari apni Torts Law ko develop karein. Hamen yeh samajhna hoga ki hamari samaj ke naitik, dharmik aur sastriya paribhashaon ko include karna hoga.
