Tortious Intent and Negligence - A Slippery Slope

torts cuet_pg advanced experience_share

Yaar, I'm still reeling from my CUET PG Law mock test, and I'm sharing my experience so we can all learn from it. Tort law, particularly Law of Torts, was a challenge for me, so let's get into it.

Section 2: I answered 6 out of 10 questions correctly, with 3 being tricky. One question was on Donoghue v Stevenson (1932), and I messed up by choosing an incorrect principle. Another one was on Vicarious Liability, and I forgot about the test of apparent authority.

Section 3: I scored 8 out of 15, but it was a close call. My weak areas were on Rylands v Fletcher (1868) and Res Ipsa Loquitur. I couldn't recall the "non-natural use" criteria for strict liability. I need to focus more on these cases and principles.

Main tokein hoon ki toritious intent aur negligence ka difference aapko samajhne ke baad nahi hota, lekin yeh baat sach hoti hai ki kuch court case mein iska interpretation different hoka hai. Maine padha hai ki kuch judges tokein hain ki negligence bhi toritude intent ke hi tarah se dekha jata hai, jo galat hai!

"Arre bhai, don't worry about tortious intent aur negligence. Ek topic hai jo kafi complex hota hai, lekin ek baar aapko ismein dhairya aata hai, to aapko yeh sab samajh mein aa jayega. Jaisa ki hamne is course mein seekha hai, tortious intent kiya hai to banti hain woh puri danda, lekin negligence koi bhi kar sakta hai.
