What if a popular social media influencer in India, with millions of followers, engages in a cyberbullying campaign against a rival influencer, who subsequently takes their own life? Let's assume the rival influencer leaves behind a 10-year-old sister, who suffers from depression due to the loss of her sibling. The rival influencer's family sues the defendant influencer for damages, alleging negligence and intentional infliction of emotional distress under the Law of Torts.

Under Section 52 of the Indian Contract Act, 1872, and Section 86 of the Indian Evidence Act, 1872, the court might apply the 'negligence' and 'intentional torts' principles to establish the defendant's liability. The court might also consider the 'reasonable person' standard, as per Section 37 of the Indian Contract Act, to determine whether the defendant's actions were 'reasonable' or not.
