Tort of Private Nuisance vs Public Nuisance confusion yaar
torts mh_cet_law advanced doubtSamajh nahi aaya, please help. Aapne koi sahi khaas jawaab dhoondhega? During my internship, a client's case got dismissed under Tort of Private Nuisance, while another case went under Tort of Public Nuisance, both involving noise pollution from a factory. But isn't both essentially same thing? What's the actual difference between these two? Is it only about the number of people affected or something more? Can it be possible that a private nuisance can become public nuisance if not dealt with? And how does the requirement of "inactionable" in public nuisance fit in here? MH CET Law exams are around the corner, aur main aise concepts se confused hoon. Help!

Bro, tort of private nuisance and public nuisance are two different beasts! Private nuisance is about interference with your land or enjoyment of your property, think noisy neighbors or stinky factories nearby. Public nuisance is about interference affecting a larger community, like pollution or noise from a public event. Not confusing, just needs understanding of their scopes.
