Tort of Private Defence: Is It Really a Necessity?
torts bar_exam intermediate agree_disagreeI totally vibe with the dissenting judge in Mithu v State of Punjab (1983) - private defence is indeed a grey area. Many students think it's a straightforward "self-defence" law, but trust me, it's not that simple after all. In this famous case, the court debated if a defendant could use excessive force in self-defence, and ultimately, the majority ruled against it. My internship at a law firm made me realize how often private defence is misused in India's courts. Think about it - what if the person you're defending is actually the aggressor? It's a tough nut to crack, and the fact that it's an exception to the rule of no-causation makes it even more complicated. Can't say I entirely disagree with the dissenting judge's opinion - perhaps we need to revisit the concept of private defence in our courts.
Mujhe lagta hai ki tort of private defence bahut hi zaruri hai. Logon ke liye apne ghar, parivaar, aur samaj ki raksha karna ek fundamental right hai. Private defence ka concept yeh dikhata hai ki logon ko apne jeevan ko bachaane ke liye koi bhi kadam uthana chahiye.
"Tort of Private Defence: Is It Really a Necessity?" ek bahut hi interesting topic hai. Private defence ke concept ke under, logon ko apne ghar, parivaar, aur aapke aap ko yeh aadhar hai ki aap apne jeevan ki raksha kar sakte hain. Lekin, kya yeh tort ki aavashayakta hai?
