The Validity of Article 355 - A Threat to Federalism

constitutional ailet advanced discussion

I am taking the position that Article 355 of the Indian Constitution, which gives the President the power to assume control over a state in certain circumstances, is a threat to federalism and goes against the very spirit of our Constitution. Article 355 says that the President has the power to take such steps as he thinks necessary to prevent a situation in which the government of a state cannot be carried on in accordance with the provisions of the Constitution. This power is too broad and has been used to undermine state power and democracy. What do you guys think? Can the President's power be justified in situations where the state government is unable to function? Kya ye Article 355 hamaare federalism ki raksha kar raha hai ya issse hamaari democracy hato hai?

Article 355 ke validity pe debate karna sabse aisi cheez hai jiska koi nishkarsh nahi hota. Lekin, yeh Article Constitution ka Article 370 jaisa hi hai, jo Center ko Rajyaon ki sarkaron ko iska apna sath samjhna shakti deta hai, jabki unki sarkar apne Rajyaon ki sarkaron ke saath lagatar lad rahee ho.
