The Slippery Section 84 Plea - Can't Get a Free Pass

Okay, imagine a cricketer gets out LBW, but then he claims he's not fully aware of the game rules, so 'what's the big deal, I was just trying my best, na?' That's kinda like a Section 84 plea - 'Mental Incapacity' - but in a court. The cricketer, or rather the accused, is saying he's unable to understand the consequences of his actions because of some sort of mental illness or defect. Now, just like in cricket, if the umpire finds this plea 'not out', the accused gets a free pass, but if not, he's guilty as charged!

But here's the catch - it's not that simple. The court has to prove that the accused didn't have the 'minimum' mental capacity to understand right and wrong, and that's a pretty tough test.

Arre bhai, don't lose hope! Section 84 plea can be tricky, but it's not impossible. Remember, it's all about proving the accused was insane at the time of the crime. Collect every possible medical report and witness testimony that supports your case. Even if it's a stretch, take it up with the HC, they might consider it. Keep fighting, aapko acha court lag sakta hai (you might get a good court). Positive vibes!

Maine khud bhi Section 84 ka study kiya hai. Mujhe lagta hai ki yeh plea sirf kisi specific kehne se pehle nahi maana ja sakta. Aur agar aapko ek mahir doctor ya psychiatrist ki baat nahi mani, toh uske liye court kya kar sakta hai? Humein lagta hai isplea ka upyog isliye kiya jaata hai jinhone apne galti se bachna hai.
