I still remember when our coaching teacher tried to explain the concept of 'first refusal' in Section 17(1)(a) of the Transfer of Property Act. My brain literally short-circuited. Like, who thought this was a good idea? The complexity is just ridiculous. Section 27, anyone? The 'onus of proof' part? Abhinav Chandrachud, SC's most recent judgement, I mean come on, the judges are as frustrated as we are. Then you have the cases - Ram Narain Das vs. Sudesh Kumar (1975) AIR SC 1339, M. S. Cooper vs. UCO Bank AIR 1981 SC 2349 - I have lost count of how many times I've read them to understand what's happening.
