When it comes to S. 82 CrPC, most people think it's a simple situation of 'if you're a minor, you're a minor, and that's it.' But NOPE, the devil's in the details. Let's say a 17-year-old, in the eyes of law, is a MINOR. You get it. Now, under S. 82 CrPC, if a minor is an adult in the eyes of the law, the proceedings shall be held in the same manner as if the minor were of full age. Sounds straightforward, right? But, in a case like Pratap Singh vs. State of UP (1991 ACJ 1237), it was ruled that the question of the minor's age should be decided on a case-to-case basis.
