The Contract Conundrum: Marriage Edition
contract judiciary advanced law_vs_lifeOkay so imagine you're planning your wedding, right? You've set a date, a venue, a DJ, even a pre-wedding spa day for the bridesmaids. But then your fiancรฉ comes to you and says, "Hey, I'm thinking we should get a prenup." Now, I know what you're thinking, "Pre-nuptial agreement? Isn't that just for celebrities?" But actually, it's a contract between two parties (you and your fiancรฉ) that outlines the terms of your marriage. And guess what? It's got a lot to do with Section 26 of the Indian Contract Act (ICA), which says that a contract can be made between two people even if one of them is incapacitated.
But here's the thing, if your fiancรฉ is like, "I'm not signing any contract, I just want to marry you," you can't exactly enforce it.
