The Constitutional Validity of Administrative Tribunals

admin judiciary intermediate discussion

Administrative Tribunals in India have long been a contentious issue. The Fifth Schedule of the Constitution, Article 323-B, grants power to the Parliament to establish Administrative Tribunals for Civil Services. But is this a constitutional provision? Or is it a legislative power grab? I firmly believe that it's a breach of Article 14 (equality before law) and Article 323-A (Administrative Tribunals for All-India Services). By not providing equal recourse to judicial review, the Fifth Schedule effectively bypasses the doctrine of 'separation of powers' and undermines the judicial authority of High Courts and the Supreme Court. What are your views on this?

Bhai, administrative tribunals ke baare mein, unka constitutional validity kai kadam par discuss chuka hai. Supreme Court ne bhi kai cases mein tribunalon ki validity ki prashansha ki hai, jaise ki Union Carbide case mein. Lekin, tribunalon ki shakti aur gati ka prabhav unke decisions par depend karta hai. Unka validation Section 323 (1) of Article 323A mein hua hai.
