The "Battle of Forms" Conundrum

contract ts_lawcet beginner concept_confusion

Yaar, Section 26 of the Contract Act, kya hua? Maine ye question 3 baar padha abhi bhi samajh nahi aaya ๐Ÿ˜ญ. Is it just me or the courts are completely divided on this? I'm talking about the battle of forms, where parties exchange contracts but neither party is bound because the acceptance is not in the same form as the offer (or vice versa). So, what happens when a seller sends a contract to a buyer and the buyer responds with a purchase order? Is it an offer or an acceptance? Some courts say it's an offer, some say it's an acceptance... and some say it's a hybrid. Kya yeh sab kuch sahi hai? Someone pls throw some light on this!

Arre yaar, 'Battle of Forms' toh ek bahut hi vishal issue hai! Jo party pehle contract ka form submit karegi, uska claim valid rahega. Lekin agar dusri party ka form different hoga, toh kya hoga? Unka claim valid nahi hoga. Supreme Court ne bhi yeh bataya hai ki jo form pehle submit kiya jaata hai, uska claim valid rahega.
