The Batsman of Originality - "Derivative Works" in Cricket Terms

ipr bar_exam advanced analogy_post

Imagine a batsman, Rohit Sharma, who hits a sixer off a ball bowled by Ashwin. Now, Rohit has a unique style of hitting, and his shot becomes super popular. A young player, who idolizes Rohit, tries to copy his style exactly, including the timing and the swing of the bat. This young player is essentially trying to pass off Rohit's originality as his own.

In IP terms, this is a problem of derivative works. The young player is creating a derivative work, which is a work based on another's original work. To avoid copyright infringement, the young player should either acknowledge Rohit's originality or create something entirely new and original. The key is to strike a balance between paying homage and not copying.

Yeh 'Derivative Works' concept bahut achi tarah se samajh aaya hai is article mein. Main ek baat add karunga - yadi koi batsman apni batting style ko dusre se copy karta hai, to use 'Originality' khel mein chunauti aa sakti hai. Lekin agar use apni batting style vikas karne ke liye inspiration milta hai, toh wah kya galat hai?
