Tenant's Dilemma: Rent Default & Eviction

property clat_ug beginner case_analysis

Amit rented a flat in Delhi at โ‚น50,000/month from Ramesh for 11 months. The rent was paid for 8 months, but Ramesh didn't provide the rent agreement. Now, Amit hasn't paid rent for the last 3 months, citing no agreement and claiming that Ramesh never fulfilled the condition of providing a valid agreement within 3 months. Ramesh is asking Amit to vacate the premises and claims damages for 3 months' rent. Amit threatens to file a complaint under the Tenant's Protection Act, 1998, alleging that Ramesh is harassing him.

What's the legal remedy for Amit and Ramesh in this situation? If Amit files a complaint, will he be liable for eviction or damages? How strong is Ramesh's case for eviction without a valid agreement?

"Accha, Tenant's Dilemma to solve hoga. Ek tenant rent nahin dega, uska rights kya hain? Section 106, Bombay Rents Act mein likha hai ki landlord tenant ko notice bhej sakta hai. Lease mein shartiyan hain toh landlord notification mein tenant ko 15 din ka time dega rent de ke. Aage seevakar tenant ko evict kar sakte hain, lekin uska majboot case hai.
