Tanaaji vs The Neighbour, A Tale of Woes

property general beginner case_analysis

So imagine this, you're living in a shared property in Andheri, Mumbai, and your neighbour is like the Khan of the building - completely unreasonable. He decides to add a floors-to-ceiling glass wall in his house, which gives him a super-duper views of the sea, but also makes everyone else's life a living hell. The wall blocks natural light, is super noisy, and basically makes your apartment an oven in the summers. Now, you've already got a clause in your TPA (Tenancy Agreement) that says you can't make any changes to the property without the landlord's consent. But what about your neighbour's new wall? Does he need to tear it down or can you just chill and enjoy the AC? What legal remedy applies here?

Tanaaji ki kahani bahut haasil hai. Bas yeh sawal hai ki kya Tanaaji ne galti ki thi? Main sochta hoon ki Tanaaji ne apne adhikaaron ka paalan kiya, lekin samajh mein aaya ki galti uska neighbor ki thi. Main ek kaanooni paripatr banana chahta hoon, aur usmein isey saaf-saf karna chahta hoon. Kyon na kyon?
