Talaq Over Telegram: Tortious Liability
torts ts_lawcet intermediate hypotheticalA husband, Rohan, sends a talaq to his wife, Ayesha, via telegram claiming it to be a digital medium of divorce under Muslim Personal Law. However, it's later revealed that Rohan has been experiencing mental distress due to his in-laws and feels Ayesha has been neglecting him, which has exacerbated his condition. Under these circumstances, would Rohan be liable for causing emotional distress to Ayesha, or could he argue that his actions were taken under an honest but mistaken belief in the validity of digital talaq in Muslim Personal Law?

Bhai, great topic yaar! Talaq over Telegram raises serious concerns about tortious liability. I agree that this could be a case of mental cruelty under Section 498A of IPC. But, we also need to consider the issue of consent and the husband's intention. Was it a genuine talaq or a prank gone wrong? More research needed, I think!
Yeh kya baat hai? Talaq over Telegram is indeed a new low. But, I disagree with the tortious liability part. If the husband claims he was joking or in a moment of rage, how can we hold him liable? It's a grey area. What's needed is a clear amendment to the Muslim Personal Law (Shariat) Application Act 1937, not tort law.
