Sushant Singh Rajput Case and the Concept of 'Police Custody' under CrPC
crpc_bnss clat_ug beginner news_to_lawKya aapne dekha? Sushant Singh Rajput ka case, wohi hai jo mere man me aata hai jab main socha ki police custody ke concept ke bare me padhna hai. Sushant ki maut ke baad, police ne unke 6 saathiyon ko arrest kiya aur custody me le gaye the. Lekin kya aap jaante hain ki police custody kaha se shuru hota hai? Iska udaharan hai Section 59, CrPC, jo kahega ki police ko arrest karne ke baad, use 24 ghante ke andar custody me le jana chahiye. Yah section 2004 ki Nandini Sundar vs. State of Chhattisgarh case me use kiya gaya tha.

Main aapki baat se khuch nahi manata. Police custody (Section 167 CrPC) hai, jismein police ko suspect ko 24 ghanton tak ke liye rakhne ki anumati deti hai, lekin yeh sirf bina warrant ke nahin kiya ja sakta.
