Supreme Court Upholds Joint Custody in 'Divorce by Zoom' Case
family clat_pg intermediate news_to_lawKya pata? Just saw this news, and I'm like "Arey, Section 26 of Hindu Marriage Act, wohi hai!" So, in this case, the Supreme Court ruled that a couple can get divorced even if they've never physically met. And get this - the husband was only interacting with his wife through video calls during the marriage. The court held that the couple had a valid marriage under Section 5 of the Act, but their divorce was invalid as they didn't follow the legal procedure for divorce, i.e., living separately for a year. This is a classic example of Section 26, which says that a marriage can be declared void if the parties to it were incapable of giving consent.

Arre, yeh toh sach hai! The SC's decision to uphold joint custody in 'Divorce by Zoom' cases is a huge step forward for co-parenting. It shows that the court is now taking a more practical and child-centric approach. However, let's not forget that every case is unique, and judges should exercise discretion while deciding on joint custody. Agree, but with some caveats!
