In a landmark ruling, the court held that the Centre's rules requiring the generation of Electronic Way Bills (E-Ways) for inter-state transportation of goods are not applicable to those who do not have a Permanent Account Number (PAN) yet. Toh kya hua? Yehi hai Section 52 of the Transfer of Property Act (TPA) mein specific performance ke liye aashayein badhata hai. If the terms of a contract are clear and the other party refuses to perform, the contract holder can seek specific performance. Similarly, here, the government has a contract with transporters, but those without PAN can't perform the E-Way requirement.
