Separation of Powers vs Overlap: A Cricket Analogy

constitutional clat_ug beginner analogy_post

Imagine a cricket team - captain (Legislative) makes strategies, wicket-keeper (Judiciary) enforces rules and batsmen (Executive) execute. Each has its defined role but some areas overlap. Captain can give a 'signal' (order) to wicket-keeper to change the fielding strategy. Similarly, laws can be changed or repealed (by parliament) but judiciary can strike them down as unconstitutional. It's a delicate balance between the three powers. But what happens when these roles blur? Imagine the captain asking the wicket-keeper to drop the ball (refuse to enforce a law), or the batsmen deciding to run the ball (executing a new policy) without telling the captain. This is where the concept of 'checks and balances' comes in. To maintain the smooth functioning of the game, these overlaps are limited by the Constitution, ensuring no single player can dominate.

Ye argument kuch ho raha hai! Separation of Powers ka concept cricket me bhi kaam karta hai, lekin kaafi overlap hota hai. Just like umpire aur captain dono ke role different hain, lekin dono hi match ka result decide karte hain. Similarly, judiciary, executive, aur legislature dono hi Constitution ka adhaar banate hain.

"Bhai, imagine cricket team ka captain, coach aur selectors ka kaam separately hote hain, lekin over lap bhi hai. Captain decide karta hai strategy, coach batting aur bowling ka advice deta hai, aur selectors team ko select karte hain. Agar captain ke paas coach ke advice ki power bhi ho, toh system balance hi khatam ho jata.
