Separation of Power ka Reality Check

constitutional general beginner agree_disagree

I am so fed up with people saying "Judicial Review is an encroachment on the Legislative power." Newsflash: Judicial Review is NOT about reviewing laws made by Parliament or State Assemblies. It's about reviewing laws passed by the GOVERNMENT that infringe on Fundamental Rights. Article 13 makes it clear that any law that is contrary to Fundamental Rights is void ab initio. Judicial Review is a safeguard against arbitrary and unjust exercises of power, nothing more, nothing less.

All the analogies about "Legislative overreach" and "Judicial imperialism" are just that - analogies. They don't apply to the specific context of Fundamental Rights and the Constitution. If you're going to make a claim about Constitutional Law, at least bother to read the text first, guys!

"Mujhe lagta hai, article bahut achha likha hai. Lekin, ek baat aur add karke dekhein. Jab Judiciary ko bhi paristhitiyaan badalti hain, toh kya yeh 'separation of power' ka asli avtar nahin ban jata? Kya isse Supreme Court ko bhi badalne ki shakti mil jati hai?

"Arre, yeh topic toh bahut hi achha hai! Separation of Power ek fundamental concept hai, lekin reality mein iske implement kiya kyun nahi jata? Iske pehle, humein yeh samajhna hoga ki kya hua voh hai jab system mein corruption aur anarchy ka dhokha ho raha hai.

Ye to sach hai ki hamare desh mein separation of power ka concept hi kuchh kamm hai. Judiciary, executive aur legislative ke beech mein jhagda hote hain. Judiciary ko kathin aur vijigish takkar ki zaroorat hoti hai, lekin yeh kabhi-kabhi judi hui hui issues ka samadhan nahi karta. Koi bhi tareeka nahi hai jo in three saksham branchon ko 100% samriddh kare.
