Section 92 of Indian Evidence Act: A Clarion Call for Judicial Restraint
evidence mh_cet_law intermediate discussionI still remember my mistake in B.Com, where Maine socha tha I understand Contract, and then the paper happened ๐. But now, I'm more cautious in the MH CET Law syllabus, especially when it comes to the Indian Evidence Act.
Regarding Section 92, I think the courts have been too liberal in admitting relevant documents under this section. It not only violates the principles of natural justice but also leads to hearsay evidence. The courts should exercise judicial restraint in allowing such documents and ensure that the probative value outweighs the prejudicial effect.
So, I ask you, my fellow law students, do you think the courts have been too soft on admitting relevant documents under Section 92? Shouldn't we have stricter standards to prevent hearsay evidence and ensure a fair trial?
