Section 91 vs Section 92: To Admit or Not?
evidence general intermediate discussionI'm totally on the side of Section 92 here! When it comes to relevant facts or documents that were available to the party, but they didn't produce them, why should we let them off the hook? They knew, but they kept quiet, and now they're asking us to admit the document anyway? It's just not fair. Take the famous case of R v. Turner (1896) where the court held that the prosecution should not have relied on certain documents because they were not produced during the trial. So, I think Section 92 is the way to go โ if you knew but didn't tell, you can't just ask us to admit it now.
What do you guys think? Section 92, yeah or nay?
