Section 83 Limitations of Liability vs. Reasonable Care

Ye section sapne mein aata hai ab, but I still can't understand it. In a case where a shopkeeper's employee accidentally injures someone, should the shopkeeper be liable for the damages (Option A) or not (Option B)? Option A says the shopkeeper can be held liable for the damages because they are vicariously liable for their employee's actions. But my textbook says the Liability of the shopkeeper is limited to the extent of their negligence in employing the reckless or negligent employee (Option B).

Which one is correct and why? Can someone please explain to me the difference between vicarious liability and limitation of liability?

Section 83 Limitations of Liability vs. Reasonable Care - A critical difference, y'all! Limitations of liability shield directors from personal liability for company debts and negligence, but only up to a certain amount. Reasonable care, on the other hand, imposes a duty on directors to act with prudence and diligence while making decisions. If directors breach this duty, they may be held liable despite limitations. This distinction can save or sink a director's reputation!

Bhai, I think you're missing the mark here. Section 83 is all about no liability if a person acts reasonably. It's not about absolute immunity. If someone takes reasonable care, they're protected even if something goes wrong! Reasonable care is subjective, so it doesn't give a free pass to reckless behavior. Just saying! - Section 83 ke khauff mein mat padho, reasonable care se aapko bhi bachne ki aadat dega.

Arre, don't worry, yaar! Sec 83 is all about limitations of liability, but the keyword here is 'reasonable care'. It's not about completely absolving liability, but rather, it's about understanding the duty of care, which is to act with such caution and prudence that a prudent person would have exercised. It's a bit tricky, but once you grasp it, everything falls into place! Keep practicing, and you'll be a pro in no time!
