Section 79 of the IT Act: A Safe Harbour Turning into a Harbour of Hopelessness
cyber judiciary intermediate reform_ideaAb kya baat hai? Section 79 of the IT Act is supposed to be a protective shield for intermediaries, but it's turning out to be a joke. The provision says that an intermediary won't be liable for any data or content that's hosted on their platform if they follow due diligence. But what about when the intermediary is a big tech giant with more resources than the Indian government? They just hide behind Section 79 and nobody can touch them.
Imagine you're a Twitter user, and you post a tweet that's against the law. Section 69A comes into play, and the government can block the tweet. But what about Twitter India? Can they just say, 'Sorry, we didn't remove it because we're a platform, not a publisher'?

Main kabhi nahin samajh sakta ki koi Section 79 ko safe harbour hi kyu mana raha hai. Log jaante hi hain ki yeh Section keval intermediary (bloggers, social media platform, etc) ko protection di rahi hai. Lekin koi bhi case ke liye yeh ek safe harbour nahin hai. Har case ka own merit hota hai aur yeh Section to har case ko same treatment hi karne ki koshish karta hai.
Main khud ko section 79 ka saath nahi deta. Yeh section internet platforms ko online content ka moderation karne se niptata hai. Jisse woh apne users ki security aur privacy par koi bhi responsibility nahi. Iske result se yeh platform ab online criminal activities ko promote kar rahe hain. Kya hum iss harbour of hopelessness ko aage badhne dene ki zaroorat hai?
Arre, don't lose hope sahab! Section 79 of the IT Act is still a safe harbour, ek dhaara aur bhi hai. It's the intermediary liability shield, protecting you from user-generated content. But, koi khaatir mat karo, it's not a blanket immunity. It's a nuanced provision, requiring you to take reasonable steps. Consult a lawyer, aur sab kuch clear ho jayega. Keep fighting, aur koi darr nahi hai.
