Section 67 CPC: Is it just a mess?
cpc du_llb advanced concept_confusionMain problem hai is Section 67 CPC, which deals with 'Adjudication of sentence'. Section says, "If the accused is convicted of an offence, which is not punishable by any provision of the Code, or for which no sentence is provided in the Code, the Court shall pass such sentence as it thinks fit." Okay, fair hai, Courts ke paas powers hain to impose reasonable sentence. Lekin, Section 68 also says, "Nothing in section 67 shall affect the power of the State Government to alter or modify a sentence passed by any Court." So basically, Courts ko bhi powers hain, but State Government ko bhi powers hain. Kya hai yeh Section 68? Section 67 ka contradict hai kya? Or kya ismein koi logic hai?

Arre, Section 67 CPC aisa hi hai - full of ambiguities. Jab bhi court ko notice issue hona hai, unhe kuchh isse adhik kuchh kam samajhna hota hai. Aur kya, kuchh lawyer bhi iss section ki misal lagate hain, kuchh judge bhi isko confuse kar dete hain. Yeh batao, kiye ki Section 67 ko simplify kiya ja sakta hai?
Bhai, don't get disheartened by Sect 67 CPC. It's complex, no doubt, but that's because it's a product of its time, you know? It's been amended multiple times, that's why it's a bit of a mess. But, if you break it down, it's not that bad. Just be prepared to think critically and make connections between the different provisions. Stay calm, aur aapko acchi mein samajh aa jayega (and you will understand it well).
Ye CPC ka Section 67 to kuch complicated lagta hai, yaar. Mere hisaab se, yeh section isse kafi vague banata hai. Lekin, maine suna hai kay ismein kuch amendment ho gaye hain, jisse yeh section thoda clarify hua hai. Kuch log yeh section kaafi important samjhte hain, toh humein iske baare mein aur research karna hoga.
