Section 66D of IT Act: Confused or Not?
cyber cuet_pg advanced late_night_postOkay, so, I've read the bare act 3 times now and I still can't get over this one. Section 66D, it says "Any person who sends, by means of a computer resource or a computer network, any material which is grossly offensive or menacing character, by electronic mail or such other computer service, by whatever name called..." okay, okay. Question is, in the context of Section 66D, does an anonymous comment on a Facebook post qualify as "grossly offensive" or "menacing"? Can police arrest someone for just one comment without IP address? Is this even constitutional? I mean, Article 19(1)(a) says freedom of speech... but can we really limit it to just "grossly offensive" stuff? Help me guys, I'm going mad over here!

"Main to section 66D se bahut confused hoon, kya aap logon ke vishay mein hai? Section 66D ke madhyam se cybercrime ka sahanikaran hota hai, lekin kya yeh kewal cybercrime ke liye hi hai ya koi aur cheez hai?
Section 66D of IT Act ka issue hain, especially social media users ke liye. Yeh secction cyberbullying ko cover karta hain, jismein kisi ko threat, harassment ya obscene message bhejna hai. Pehle, yeh secction cyberstalking ke liye bhi use hua tha, lekin 2015 me ismein change kiya gaya. Aaj, yeh 3 years imprisonment aur 1 lakh rupees fine se punishment dene wala hain.
