Section 6 of Hindu Succession Act: Can't Get My Head Around It

family clat_ug advanced concept_confusion

mai samajh nahi aaya, kya main hi confused hua hoon. Section 6 ke under, sharirik sabit jaankari se sharirik stithi ki sajha kya hoti hai? Toh kya yeh sajha mere pita, maa, or mujhse bhi hoti hai, or phir kya? Maine ye question 3 baar padha aur abhi bhi samajh nahi aaya ๐Ÿ˜ญ. Is section ke 2 parts hain, aur dilon ke saath kaha ja raha hai ki dono alag-alag tareekon se sajha lagate hain. Lekin mujhe lagta hai ki isme lagatar confusion hai. Koi batayega ki main kya kar raha hoon galat.

Bhai, section 6 ke bare mein aapka confusion, toh thoda aur samajh mein aata hai. Ye section women's right mein badlaav laata hai, lekin aisa nahi hai ki usse har woman ko inheritance mil jata hai. Lekin, agar woman ka husband hai, toh vah unke inheritance ko manage karega. Isse to women ko ek tarah ki property right mil jaati hai, par complete control nahi.

Hai friend, let's break it down. Section 6 of the Hindu Succession Act clarifies that if a female Hindu dies intestate (w/o a Will), her property will be divided equally among her heirs as per the order of succession. But here's the catch - it also talks about 'ancestors' (pitri doshoms), who get priority over descendants. So, if a childless woman dies, her property goes to her parents or grandparents, not her siblings or parents-in-law. Make sense now?
