Section 59: Is Hearsay Allowed?
evidence cuet_pg advanced concept_confusionTumheh confusion lag rahi hai kya? I mean, me too! I was reading Section 59 of the Indian Evidence Act and I'm like 'Kitna confusion hai yeh!' Hearsay is a major exception in this section, but then it says that any information given by a person is admissible if the person is dead, absent or incapable of giving evidence. But what about hearsay then? Isn't that when someone tells someone else something they heard from someone else? I mean, that's what I thought. But no, the section says it's admissible if the person is dead/absent/incapable. So is hearsay allowed or not? I'm so confused, like when you watch a cricket match and the umpire gives two different decisions in an over. What do you guys think?
