Section 52 of the Copyright Act: The "Fair Deal" of No Return
ipr du_llb advanced reform_ideaYeh provision to kya hai? Section 52 of the Copyright Act states that if someone has made a copy of a copyrighted work, and that work is no longer available in the market, then they can keep that copy for their own use. Sounds fair enough, na? But here's the catch - if they want to share it with someone else, forget it. They can't even give the copy to their friend. Yeh to kaisa fair play? It's like, what's the use of a fair deal if it's not fair to others? This provision makes no sense in 2025, especially when we're all about sharing and collaborating online. We should reform this section to allow for sharing and promotion of art, without harming the creators. It's high time we updated our IP laws to match the times.
