Ye toh main samajh hi nahi pa raha.

Main aapse naheen samjhta, koi log to iska kafi hi vishayik vartalan kar rahe hain. Lekin meri khasmena ye hai ki koi bhi apne vicharon ko aise peeshane mein naa khele ki Section 52 CPC se hamesha transfer of suit hota hai. Har khad se har khad case different hai, aur isliye hamein apni apni soch karni chahiye.
Section 52 CPC is indeed a tricky one! The provision for the transfer of suits doesn't specify clear guidelines for the court to follow. It leaves the discretion of the court quite wide. The court's power to transfer the suit should be exercised judiciously, keeping in mind the principles of natural justice and fairness.
