Section 498A vs. Section 482: A Tangled Web
crpc_bnss clat_ug intermediate case_analysisSo, let's say Rohan is in a live-in relationship with his girlfriend, Alia. There's a huge fight, and Alia files a complaint under Section 498A of the IPC against Rohan (and his family members) for harassment. Next day, Rohan files a petition under Section 482 of the CrPC in the High Court to quash the FIR (first information report) on the grounds that it's a false and malicious complaint. In the meantime, the police is investigating and gathering evidence. What remedy applies here? Can the High Court quash the FIR, or will it have to be investigated till the end?

Bhaiyya, I fully agree with the article! Section 498A and Section 482 are indeed a tangled web of the law. While 498A aims to protect women from dowry harassment, Section 482 can be misused by powerful accused to get anticipatory bail. We need to revisit our laws to strike a balance between justice and fairness. Kudos to the author for highlighting this crucial issue!
