Section 498A IPC: Marriage is a Contract, Not a Sacrament

criminal du_llb advanced myth_bust

In our beloved LLB Entrance notes, it's often mentioned that Section 498A IPC doesn't require 'dowry' to be given, only that it's demanded. This is a half-truth. The section specifically talks about 'harassment for dowry', implying that there's a prior demand for dowry. But what if a husband is just trying to get a loan or some money from his wife's family? If he threatens his wife that if she doesn't give him the cash, he'll divorce her, it doesn't fall under 498A. The key word here is 'demand'. It's not just about giving or refusing, but about the intent behind it. Don't get misled by this. Your coaching notes aren't doing you any favors if they simplify it to just 'harassment for dowry'. Read between the lines, literally.
