Yar, I'm having a major disagreement with my friend Raj over this one. We both got our notes from same book but somehow he's saying it's this way and I'm saying it's that way.

Question: A person committing breach of data security safeguards by not using reasonable security practices and procedures, is liable to: A) Pay penalty up to Rs. 5 lakhs B) Pay compensation to the person affected C) Both A and B D) Neither A nor B

Raj says it's A, he thinks it's just a penalty of Rs 5 lakhs. I'm saying it's C, both penalty and compensation. I think compensation is the key here - a person affected can also get compensation from the person who breached their data security.

Bhai, mujhe lagta hai yeh section 43A IT Act 2000 mein cyber insurance se judi hai. Yeh section 43A ke hisab se online business ke liye cyber insurance karna zaroori hai, agar us business mein user data leak ho rahi hai, toh company ko damages compensate karna padega. Agar company ne cyber insurance li hai, toh uski kam mat jaegee.
