This section allows the court to grant bail to a person who fears arrest, on the condition that they appear before the court when required. It's a safeguard against police high-handedness and harassment. As per Section 438(1) - 'When a person has reason to believe that he may be arrested on the basis of any non-bailable warrant or summons or on the basis of an order under section 482 of the Code of Criminal Procedure, 1973 (2 of 1974), he may apply to the High Court or the Court of Session for a direction for the issue of an order for anticipatory bail to him."

Section 438 CrPC wale provisions kuch aur clear karte hai. Ye anticipatory bail ka right deta hai agar aapko aane wali FIR mein giraftaar hona hai aur court ko yakeen aata hai ki aapko justice ki vitaran mil paayegi. Arnab Goswami ka case is case ka hi example hai. Lekin iski vajah se FIR bhi karna koi chhota crime nahi hai. Court bhi aise cases ko serious consider kerte hai.
