Section 438 anticipatory bail k challenge bahut mushkil hai. Kuch courts ke according yeh power High Courts ke paas hai aur kuch ke according yeh power Supreme Court ke paas hai. Aapki team ko Supreme Court ke 1997 ke D.K. Basu case aur 2020 ke Arnesh Kumar case ko padhna hoga, jahaan iska interpretation kiya gaya hai. Abhi yeh court k liye bahut mushkil case hai.
Main aapki baat nahi sahi maana! Anticipatory bail under Section 438 CrPC is not a challenge, it's a safeguard provided to individuals who fear arrest. If HC or SC grants anticipatory bail, it only means the court believes the person's fear of arrest is genuine and he won't hamper the investigation. It doesn't mean they're not guilty.
