Section 354D IPC vs Section 228A IPC: Which One Applies?

criminal judiciary advanced poll_style

In a recent Mains question on Judicial Services, I was torn between two options and I'd love to hear from you guys which one is correct. Suppose a social media post shares the identity of a rape survivor without her consent. Option A says that under Section 354D IPC, the accused can be held liable for sharing such content. Option B claims it's Section 228A IPC that applies here.

Which one do you think is correct and why? Do we lean towards the IPC section governing disclosure of information identified with the victim of certain offenses (Section 228A) or the one that deals with voyeurism, stalking, and other related offenses (Section 354D)? Let's talk about this!

Kya baat hai, I disagree with your interpretation. Section 354D IPC ka focus hai parivaar ko pehchanane aur samvaad karne ka adhikar dena, but Section 228A IPC mein victim's identity ka protection shamil hai. Agar victim's identity expose ho jaaye, toh 228A IPC lagu ho sakta hai. Dono sections different situations mein apply hote hai, mere vichar mein.

Section 354D IPC aur 228A IPC mein koi similarity nahin hai. Section 354D mein cybercrime related cases ki shikayat kiye jaane ka matlab hai aur aisa lagta hai ki ismein victim ka identity ka protection ke liye regulation ki ja rahi hai. Jabki Section 228A IPC mein victim ka identity ka protection ke liye regulation ki ja rahi hai lekin ismein koi cybercrime specific rule nahin hai.
