Section 304 B: A Loophole in Indian Penal Code

criminal general intermediate reform_idea

Bhai, you won't believe the number of times I've seen this one get misused. Section 304 B talks about causing death by rash or negligent act not amounting to culpable homicide. The thing is, it gives a clean chit to people who cause accidental deaths but can still manage to show they didn't mean to harm anyone. Problem is, if the victim's family files a case, the 'accidental' label gets disputed and the accused is back on hook. And guess what? The court looks for proof that 'real negligence' was there. How's that even possible? The law is outdated, man. Today we know better, and accidents will happen. We need to make the law more clear-cut, not create loopholes for people to exploit.

"Section 304 B ki kritiyan bahut saari hain, lekin yeh shabd sabke liye nahi hota. Yeh shabd keval uske liye hota hai, jo jaankar apne aap ko ismein shaamil karte hain. Lekin, humein apne man mein ye yaqin hona chahiye ki hamein iske liye judne se pehle apne adhikariyon se sampark karna chahiye.
