Section 304(2) IPC: Abetment to Suicide - Confusing or What?
criminal judiciary advanced concept_confusionBhai, I've been trying to wrap my head around Section 304(2) IPC, and I'm completely lost. According to this section, if someone abets a suicide, they can be punished with imprisonment for a term which may extend to one year, or with fine, or with both. But then, Section 312 IPC says that whoever causes a woman with child to miscarry, or if she dies in consequence of the miscarriage, shall be punished with imprisonment for a term which may extend to seven years, and shall also be liable to fine.
Is it just me or is this a clear case of contradictory laws? If abetting suicide is punishable with a maximum of one year, then how can causing a miscarriage be punishable for up to seven years? I'm trying to understand the logic behind this, but it's just not clicking.
