Section 300: The "Cynical" Culpable Homicide Law

Yeh 1860 ke law abhi tak theek hai ya nahin? Kya ye "culpable homicide not amounting to murder" vishesh kyun hai? Article 299 Section (i) mein likha hai, "If the person causing the death knows that by doing so he would in all probability cause death or grievous hurt, but notwithstanding such knowledge or a person of average culpability would neither expect such a result nor mean to cause it." Toh kya ye kaha raha hai ki agar aapne apne aas-pas ke logon ko dekh kar apni gadi par ghus jana ho, toh wahan se mar nahin pade to koi baat nahin? Bas yeh "average culpability" kya hai?
