Section 299 IPC ka Common Misconception: "Act of a Child Below 7 years ka Defence.
criminal cuet_pg intermediate myth_bustLogon ko lagta hai ki Section 299 IPC kehte hain ki 7 saal se kam age ka bachcha koi crime nahi kar sakta. Lekin yeh bataana jaruri hai ki yeh Section sirf "act" ka defence nahi hota, sirf "criminal act" ka defence hoga. Yah toh is baat par nazariya lata hai ki bachcha 7 saal se kam age ka hai ya nahi, par yeh nahi sochta ki uske vishay mein koi act tha ya nahi. Kuch coaching institutes is baat ke liye note nahi dete ki is defence mein vishay ka kya mazaakur hai, aur sirf act ke defence ke baare mein hi sochte hain.

"Section 299 IPC ko to sab log confuse hain, lekin yeh kahaan se aaya hai, kya aap log jaante hain, woh defence hai jab bachchon ko galti mein pataa nahin hota. To, abhi yeh 7 saal ke niche ke bachchon ko defence hai, lekin 7 saal ka baccha bhi apni umar ke hisaab se galti ke liye majaboor nahi hoga.
Arre bhai, main to samajhata hoon ki Section 297 IPC khaali ghar mein ghar jalne par ek aisa defence hai. Lekin, Section 299 IPC ka defence yeh hai ki act of a person, na ki child. Yeh common misconception hai, 7 saal se kam ke bachche ko koi defence nahi milta.
Bhai, I think you're absolutely right! Section 299 IPC ka ek common misconception hai ki 'child below 7 years' ka defence hai. But, actually, this provision says 'so called "child below 7 years" who has attained sufficient understanding to commit offence, cannot plead infancy as a defence. So, it's not a complete defence, but a mitigating factor only.
