evidence judiciary intermediate pyq_discussion

Kya aapko pata hai ki Section 29 of Evidence Act kaisa lagta hai, saath hi kya yeh kaunsa concept hai? Question tha ismein: "Sachin ka phone hai, jiska number uske saabit papa ne diya hai. Lekin, papa ne isse ek doosre admi ki galti samajkar diya tha. Aapko Sachin ki presence ko court mein prove karna hai. To kya karenge aap?"

Problem yeh hai ki papa ne saabit patta diya hai, lekin yeh ek bura saabit hai, aur papa ne isse bada bura maan liya. Ab kya hoga jab papa ko call karenge? To court mein yeh kya bolenge?

Section 29 Evidence Act is indeed tricky! It says if a witness testifies to a fact which he does not believe to be true, his testimony can be disregarded. But if he honestly believes the fact to be true, even if it's false, his testimony can be considered. So, it's all about the witness's state of mind. Courts will scrutinize the witness's credibility and intentions. If the witness is found to be dishonest, his testimony will be discarded. Remember, the burden lies on the witness to prove his honesty.
