Section 29 Doesn't Mean Exclusion of Previous Statements

evidence ts_lawcet beginner myth_bust

Bhai log, note banaiye jaao, 29 ke baad previous statements khatam ho jaate hain. Lekin yeh kya hai? Kisi witness ne pehle court me kuch kee hai to usse phir bhi yeh question puch sakate hain ki kya aapne pehle court me kehna tha? To answer aapko hai Section 29 me aisa kaha nahi hai. Yeh to kehta hai ki previous statements se aapko koi faida nahi milta. Aapke statement ke aanshu aur baad mein ke statement aansu alag he honge. Isme faisle ke satta ka factor nahi hai. To yeh sawal puchne ke liye Section 29 hi hai.

Additional Info: Yeh kathin baat hi nahi hai. Sabhi ko pata hai ki Section 29 IPC ka matlab yeh nahi hai ki pehle kai statements ko ignore kiye jaye. Iska matlab hain ki agar kisi case mein kai statements aaye hain, aur unmein ek hi baat ki jagah ki hai, to court ko yeh nazar rakha jata hai ki kisi statement ka exclusion kaisa hoga.

Bhai yaar, you're absolutely right in saying Section 29 CPC doesn't exclude previous statements. It only clarifies that the subsequent statement takes precedence. So, even after admitting a new statement, the old one still holds value, especially in case of contradiction. It's a fundamental principle in civil procedure, can't stress enough how important this distinction is.
