Section 27 of TPA vs. Easementary Rights - Paradoxical Relationship
property du_llb advanced concept_confusionSection 27 of Transfer of Property Act says it's only a burden if there's some direct physical attachment, but then it clashes with the concept of easementary rights where I don't have a right, title or interest yet it affects my land. How can this be possible? The way it's worded in the textbook by XYZ coaching centre, it's like a puzzle with too many missing pieces. They're just skimming the surface, and I'm still trying to get to the root. Can someone throw some light on this or is this just another brain-twister in the world of property law?
