Section 141 CPC - The Grandparent Clause

Our lawyer explained to me that Section 141 is often used in suits by legal representatives. But what I found interesting was that it has a subsection (141(1)(d)) that allows the court to appoint a guardian for a 'person of unsound mind'. The thing is, the law doesn't define what 'of unsound mind' exactly means, leaving it to the court to decide. It's kinda like how Ranveer Singh's character in 'Gully Boy' tries to navigate the complexities of the music industry, and in this case, the court has to navigate the complexities of a person's mental state.

Main aapke vichar se nahein khete hain, Sir. Grandparent clause Section 141 CPC ka matlab yeh nahi hai ki court kisi bhi suit mein apna notice apna sakta hai. Iska matlab yeh hai ki koi bhi court jo yeh sochhti hai ki jo notice hai use sunne ki jarurat hai, woh notice apna sakta hai. Lekin kuchh adhikar khatam hone par court kya kar sakta hai?

Section 141 CPC ka naam 'The Grandparent Clause' hai, lekin ismein 'grandparent' ki koi relation nahi hai. Is section mein CPC ki 138 kadi clause ki wajah se isey grandparent clause kehte hain. Ismein court ko bataya gaya hai ki jab 138 ki kadi clause ke liye 15 din se adhik samay ho gaya, to court us article ki kadi clause ko apne vicharon se mandir kar sakta hai.
Mujhe lagta hai ki Section 141 CPC ek bahut hi aham tareeke se isey parent clause ke saamne Grandparent clause kehte hain. Yah clause aapko apne parent clause me jo kuch nahi likha gaya hai, vohh apne grandparents me apply karne me madad karta hai. Aapko yeh clause samajhna honge aur apne exams me achi tarah se perform karna hoga.
Maina ek problem hai jo Section 141 CPC ke saath judi hai - Grandparent Clause. Ye clause, jo ki ek old provision hai, ab aapka kadam lagane ke baad hi karya karta hai. Agar apni kanooni pehchan ke liye, aapko apne ancestors ke documents ko search karna padega, jo ki ek bada jhagda ban sakta hai. Main aapke saath yeh samjhta hoon, yeh ek adhikari nahi hai.
