Section 138 of NI Act: Demand for Payment or Adjustment of Payment vs. Claim for Dishonoured Cheque

cpc ailet beginner doubt

Yaar samajh nahi aaya, please help! I'm really confused between Section 138 of the Negotiable Instruments Act and CPC Section 340, specifically when it comes to dishonoured cheques. In Srei Infra Finance Ltd vs. Neeraj Gulati (2021 SCC 1), the SC ruled that Section 138 demands repayment or adjustment of the amount. Now, while reading about CPC Section 340, it seems like it's related to the same situation โ€“ a person claiming damages for a cheque bouncing. But the part that confuses me is that CPC Section 340 explicitly mentions payment, whereas Section 138 doesn't specify payment, it only talks about repayment and adjustment. What's the difference between the two? Is CPC Section 340 applicable only when payment is not possible? Please explain this confusion.

Arre bhai, Section 138 of NI Act mein to clearly hai ki koi bhi karyakarta dishonoured cheque ka karyalay mein pradarshan ka aapna daayitva nahi rakh sakta hai agar payment ka prayas hai. Toh demand for payment ya adjustment of payment ke liye aapko ismein lagu karne ka samay hoga, phir karyalay mein filing karna hoga.

Bina notice ke koi bhi claim valid nahi hoga. Ye kya aapke saamne hua hai?
