Section 138 NI Act vs. Contract Law: Confusion Ka Mahal

I thought I understood it as a law related to cheque bounce cases, but then I started reading about the contract law aspects and I'm like, arre, yeh Section kya kar raha hai? It says that a cheque bounce case is a civil matter, but then it gives the court powers to award harsh punishments, including imprisonment. Is it just me or is this a complete contradictory approach? In contract law, we learn about the principle of 'ubi jus ibi remedium' (where there's a right, there's a remedy) but Section 138 seems to have its own rules.

Section 138 NI Act ka dhyan rakhkar hamein yeh sochna padta hai ki kya vartmaan contract mein dishaayak kee dhang se payment kiya gaya tha ya nahin. Jyada sawal uthana hoga ki payment ke tareeke par vartmaan contract ka pahaloo kya hai.

Section 138 NI Act dishonour of cheque ke cases ke liye hai, jabki contract law ka upyog general disputes ke liye hoga. Agar dishonour of cheque ka case hai, to Section 138 NI Act upyogi ho sakta hai.

Lekin, jab ek bank chalan deta hai, toh voh section 138 under apply hota hai. Bas yeh batana hai ki contract law ke terms and conditions ko pura karne ke liye chekout karna padta hai, tabhi pata lag sakta hai ki 138 apply karo ya na karo.
