Section 138 NI Act: A Run-Out in the Game of Cheques

crpc_bnss ts_lawcet advanced analogy_post

Imagine you're playing cricket and you give a batsman a loan to hit a six. But when the batsman can't pay off the loan, you issue a notice saying 'either repay or we'll declare you out, loser!' If he still doesn't pay, you can file a case against him. In Section 138 of the Negotiable Instruments Act, this batsman is like the cheque issuer, and you're the lender. You issued a cheque expecting payment, but it bounced. You gave the issuer a chance to make it right, but they didn't. Now, you have grounds to file a case against them. It's all about following procedure โ€“ issue a notice, and if they still don't pay, you can go to court.

Arre bhai, don't lose hope! Section 138 NI Act ka case lagana mushkil hai, but kahaaniyan hai jo jeet gya hai. Ye sab dependent hai apne case ki preparation par, aur apne advocate ko. Pehle apne lawyer se baat karein, aur phir file karein. Har koshish ki ja sakti hai. Apne rights ke liye ladna aapka haq hai. Sab theek ho jayega.

Aapko lagta hai ki Section 138 NI Act mere liye "Run-Out" hai, lekin maine yeh socha hai ki yeh law ki zaroorat hai. Kyunki agar hamaare paas cheques ka system nahin hota, to banking system aur trade ki azaadi ki kya baat hogi? Cheque bounce ka khata hai, lekin iske liye koi sahi tareeka nahi diya ja raha hai.
