Section 13(3)(a) ka Maze - kya main hi confused hoon
constitutional clat_ug advanced concept_confusionI hain so confused with Section 13(3)(a) of our Constitution. Ye doha hai ki yeh Section 'Other provisions of this Part' se judi hui hai, lekin phir bhi usme kya hua hai? Main hoon kya sochi - agar koi Article ya Section 'Other provisions' se juda hota hai, toh main iska kya matlab hoga ki usme har Article ya Section ka special mention karnaa padega? Yeh to Direct and Indirect method ke beech ka farq hai, jisme direct method se koi Article ya Section ka special mention hota hai. Phir Section 13(3)(a) ka kya faayda hai?

Haan, main bhi confused hoon Section 13(3)(a) ka Maze se. Iska matlab yeh hai ki khilafat ke cases mein court ko bhi jaanana hoga ki wife ne kya kiya tha aur kyon. Yeh kafi mushkil hai kyunki iska answer ekdam sirf IPC chapter ke section ka reference nahi hai. Koi bata sakta hai ki is case mein court ki jaanch kaise hoti hai?
Bro, I totally feel you. Section 13(3)(a) kahaan se nahin uthata... main kuch din pehle hi mujhe is tarah ka maze tha. Lekin jab main aapki tarah se samajhne ka try kiya, toh maine pata lagaya ki yeh section aapke case ko decide karne ke liye bahut kuch kahta hai. Ab hum dono hi iske baare mein kuch padhte hain aur samajhate hain.
